Terms of Use/Privacy Policy

1. Acceptance of Terms. By using or accessing any part of AllAboutWaterfront.com (AAW) you agree to accept the following terms, and to comply with them. AllAboutWaterfront.com and International Waterfront Properties Inc. reserve the right to terminate access or use of its services to anyone not complying with these terms, with or without notice. If you do not accept any of these terms, you must not use or continue to use AllAboutWaterfront.com or any of its services.

2. Applicable Law. These terms of use shall be governed by the laws of the Province of Ontario, Canada, without regard to conflicts of law provisions.

3. The purpose of International Waterfront Properties Inc. and AllAboutWaterfront.com is to provide an internet-based publishing, information and advertising service (the Service). International Waterfront Properties Inc. (and AllAboutWaterfront.com) is not a licensed real estate brokerage company, does not offer brokerage services, or trade in real estate in any way. It is an information and advertising website for Owners of waterfront property employing real estate agents, Buyers of waterfront property employing real estate agents, and Owners of waterfront property who are selling property privately without a Realtor. Neither International Waterfront Properties Inc. nor AllAboutWaterfront.com receives any commissions or referral fees whatsoever in connection with the sale of any property listed on the website.

4. Website Content. All content on AllAboutWaterfront.com is the property of AllAboutWaterfront.com and International Waterfront Properties, Inc., and may not be modified or used for any purpose except personal non-commercial use. All information and content submitted by real estate agents, property owners, or any users of AllAboutWaterfront.com to the website becomes the property of AllAboutWaterfront.com and International Waterfront Properties Inc., and remains so even if the content is subsequently removed, cancelled, or hidden from public view. AllAboutWaterfront.com reserves the right to refuse, modify, move, or remove any content or information provided on the website at any time and for any reason. No compensation will be provided in the event that content is refused, modified, moved, removed, cancelled or hidden from public view. AllAboutWaterfront.com does not guarantee or warrant the accuracy of any user-provided content or information.

5. No Liability. Use of this website constitutes acceptance that AllAboutWaterfront.com, International Waterfront Properties Inc., and all of their directors, employees and agents will not be liable for any loss or damage suffered as a result of use of or reliance on the website or any of its content. Content from real estate agents, property owners, or any other use is provided strictly “as is” without any warranties or guarantees of any kind and any reliance on it will be at your own risk. In no event will AllAboutWaterfront.com or International Waterfront Properties Inc. be held liable for any direct, indirect, punitive, incidental, special, or consequential damages resulting from using the website or its services, third party mortgage and/or currency calculators or any other incorporated third party services, a failure to provide services, or from a delay, interruption, error, or loss of data. Any use of AllAboutWaterfront.com shall be at your own risk. If you do not accept this no-liability term or any portion thereof, you must not use or continue to use AllAboutWaterfront.com or any of its services.

6. Permission of Property Owner requires written consent. Any user of AllAboutWaterfront.com who provides information about a property, including posting a listing for sale, must have the written permission of the current property owner to do so (this is commonly but not always accomplished with a signed, formal MLS listing agreement giving authority to the listing Realtor to advertise the property and may include permission for that property to be advertised on a real estate board Multiple Listing Service system and/or other media). Advertising the sold price AFTER the closing date requires the new Buyer’s permission in writing as well. Users must acknowledge that they have the owners’ permission(s), in writing and be able to provide proof of permission(s) on demand.

7. Collection of Personal Information. To access features of AllAboutWaterfront.com, AllAboutWaterfront.com may ask you to provide personally identifiable information. Personally identifiable information includes personal characteristics such as age, gender, home address or phone number. Your disclosure of such information will always be voluntary. While personally identifiable information is protected by this privacy policy, business information is not. Business information includes business addresses and phone numbers.

8. Use of Information. AllAboutWaterfront.com will only use personally identifiable information collected to serve our clients. Such uses may include marketing services (providing information to potential Realtors and/or Buyers), invoicing, or communicating with clients and customers.

9. Disclosure to Third Parties. AllAboutWaterfront.com will not disclose, sell, or trade to outside parties any personally identifiable information collected in the course of providing services to you, unless you have expressly consented to such disclosure. AllAboutWaterfront.com reserves the right to disclose personally identifiable information to comply with applicable laws and lawful governmental requests, or to investigate and help prevent potentially injurious or illegal activities. Use of and/or disclosure of your personal information by Third parties is not the responsibility of AllAboutWaterfront.com. Such use and/or disclosure are instead governed by the Third parties privacy policies. AllAboutWaterfront.com, International Waterfront Properties Inc., and all of their directors, employees and agents will not be liable for any loss or damage suffered as a result of Third Parties use of your personal or business information.

10. “Cookies”. AllAboutWaterfront.com uses cookies to collect and aggregate certain non-personally identifiable information about its users in order to improve the features of its website. “Cookies” are small packets of information stored on your computer’s hard drive by your web browser to track preferential information about your web browsing. Cookies do not contain personally identifiable information.

11. Links to Other Websites. These terms of use and privacy policy apply exclusively to AllAboutWaterfront.com. AllAboutWaterfront.com may contain links to other websites, however AllAboutWaterfront.com makes no representations or warranties regarding such websites. AllAboutWaterfront.com and/or International Waterfront Properties Inc. shall not be responsible for the use and privacy practices of any third party website, and encourages you to review the terms of use and privacy policy of any third party website, which may differ from this these terms.

12. Property Listing Guidelines and Policies (the “Service”)

General

• • You must read, agree with and accept all of the terms and conditions contained in this Terms of Use/Privacy Policy Agreement including this Property Listing Guidelines and Policies (the “Service”) before you may become a Member of AllAboutWaterfront.com (AAW).
• • We reserve the right to modify or terminate the Service for any reason, without notice at any time.
• • We reserve the right to refuse service to anyone for any reason at any time.
• • Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis without any warranty or condition, express, implied or statutory.
• • AAW does not warrant that the service will be uninterrupted, timely, secure, or error-free.
• • AAW does not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
• • You must be 18 years or older to use this Service.
• • You must provide a valid email address and any other information needed in order to complete the signup process.
• • You are responsible for keeping your password secure. AllAboutWaterfront (AAW) cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.
• • You may not use the Service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of the United States, Canada and the Province of Ontario.
• • You are responsible for all activity and content (data, graphics, photos, links) that is uploaded under your AAW account.
• • You must not transmit any worms or viruses or any code of a destructive nature.
• • A breach or violation of any of the Account Terms as determined in the sole discretion of AAW will result in an immediate termination of your services.

Specifics

a. All properties you post on AAW must be on the waterfront or have a legitimate waterfront view to be eligible to be listed for sale on AllAboutWaterfront.com. We define ‘Waterfront Property’ and ‘Waterview Property’ in our on-site ‘Waterfront Words’ Glossary’ HERE. One or more of the carefully considered photos in your listing should clearly and unambiguously reflect one or the other of these definitions. In order to maintain the integrity of the website, a non-complying listing will be immediately removed without notice and in accordance with Paragraph 4 of these Terms of Use.

b. All listing packages are for 30 days as indicated on the listing package you have purchased. After your 30 day FREE trial, you will be billed every 30 days to continue. This offers you the most flexible options possible. Please note:

• • Each individual ad is for a specific property.
• • Ads for multiple homes, lots, condos etc. or your business (in general) are not allowed but may be referenced on our FORUM (coming) and cross-linked to a specific listing.
• • If you have purchased a multiple ad package, you can replace a listing that has expired or is cancelled with a new listing for the balance of the 30 day billing cycle for that ad.
• Note: All payment plans are billed on a mere 30 day cycle, so no refunds or credits are given for cancellations.
• You understand that your Content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit Card information is always encrypted during transfer over networks. • • checking and maintaining the accuracy of your listing once posted on this site (as well as any and all other content you post on this site) and
• • making any necessary corrections promptly, and
• • recording all required updates (including new prices, SOLD, or SOLD details, etc.) and
• • obtaining as discussed above, all necessary, verifiable permissions from both Sellers and Brokers (as required by law in most areas) to publish or advertise any property listings on this site. You agree to fully indemnify International Waterfront Properties Inc. and AllAboutWaterfront.com against any and all liability that may occur as a result of your failure to obtain whatever permissions are required for any reason and/or in any legal jurisdiction.

d. If a property is SOLD at any time during the listing period, congratulations! In that case, in order to protect the accuracy of our database, you must immediately update the “For Sale” field to “SOLD” and enter the ‘Sold Price’ (and the date it sold) in the appropriate fields, using your password access to the listing.

e. After a listing is SOLD, your ad will remain on our website for 3 months for market analysis. If you prefer that a sold property be removed at an earlier date, we will gladly accommodate your email request. HERE.

f. Technical support is only provided to paying account holders and is only available via email or the support forum.

g. Delivery & Refund Policy: Your waterfront/waterview listing will appear on the site within 48 hours of receipt of a properly completed (by the User) Internet-based form/fields providing the data necessary to complete each advertisement and prepare it for publication in accordance with the ‘Property Listing Guidelines and Policies’ in our ‘Terms of Use/Privacy Policy’. The 48 hour interval is a maximum, allowing the Publisher the necessary time to screen all submissions for inappropriate and/or incomplete content.
Please note there are no refunds for listings that appear for less than the full 1 month term stipulated for each listing. This might occur in the event that your listing has been SOLD, has expired or has been taken off the market. If you are not completely satisfied with the service we provide or the function of the website, and we cannot resolve the issue within 72 hours of you notifying us by email to customerservice@allaboutwaterfront.com we will happily refund you the balance of the monies not used in the fulfillment of your prepaid advertisement.

h. AllAboutWaterfront.com reserves the right to reject, modify or remove any blog, forum or listing submission that is not deemed appropriate in our sole discretion and/or does not conform to the said ‘Property Listing Guidelines and Policies’ and AllAboutWaterfront.com’s ‘Terms of Use/Privacy Policy’. No compensation will be provided in the event that any content is rejected, modified or removed.

i. The failure of AAW to exercise or enforce any right or provision of the Terms of Use/Privacy Policy shall not constitute a waiver of such right or provision. The Terms of Use/Privacy Policy constitutes the entire agreement between you and AAW and governs your use of the Service, superseding any prior agreements between you and AAW (including, but not limited to, any prior versions of the Terms of Use/Privacy Policy).

j. Modifications to the Service and Prices:

• • Prices for using AAW’s Service are subject to change without notice upon renewal.
• • AAW reserves the right at any time to time to modify or discontinue the Service (or any part thereof) with or without notice.
• • AAW shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

13. Changes to Terms of Use/Privacy Policy. AllAboutWaterfront.com reserves the right to change the Terms of Use/Privacy Policy at any time and without notice. International Waterfront Properties Inc. and AllAboutWaterfront.com encourages its users to review the terms of use and privacy policy from time to time to keep informed of any changes. Continued use of AllAboutWaterfront.com after a new Terms of Use/Privacy Policy is posted shall indicate acceptance of any changes to these terms.
